BackToYou provides NFC keychain tags and a private web page that helps a finder reach a child's parent. We are not an emergency service, not a tracking or location-monitoring service, and not a substitute for calling 911.

In an emergency, always call 911 or your local emergency number first.

You must be at least 18 years old and the legal parent or guardian of any child whose information you register. By creating an account, you confirm both of these things, and you confirm that you have the authority to consent to the collection and display of that child's information as described in our Privacy Policy. Children may not create accounts.

You are responsible for keeping your account credentials and two-factor authentication device secure, and for all activity that occurs under your account.

By registering a phone number with BackToYou, you consent to receive transactional SMS alerts from BackToYou at that number when your child's tag is scanned or when someone shares their location. These are transactional service messages, not marketing messages, and message frequency depends on how often your tag is scanned.

Message and data rates may apply. You can opt out at any time by replying STOP to any message; to opt back in, reply START. Reply HELP for help, or email support@backtoyoubty.com. Carriers are not liable for delayed or undelivered messages. If you opt out, you will no longer receive scan or location alerts by SMS.

You confirm that you are the subscriber or authorised user of every phone number you register, and that you have permission from the owner of any second phone number you add.

• You may only register tags for children you are the legal parent or guardian of.
• You agree to keep your contact information accurate and up to date.
• You agree to deactivate tags you no longer use.
• You may not use BackToYou for any illegal purpose.
• You may not attempt to access another user's account or tag data, scrape or bulk-request tag pages, probe or bypass our rate limits or security controls, or interfere with the operation of the service.
• You may not upload content that is unlawful, or that you do not have the right to upload.

You keep ownership of the information and photos you upload. You grant us a limited licence to store, display, and transmit that content solely for the purpose of operating the service — that is, to show it on your tag page and to send your alerts. You are responsible for making sure the content you upload is accurate and that you have the right to provide it.

We do our best to keep BackToYou running reliably, but we do not guarantee uninterrupted or error-free service. The service may be modified, suspended, or discontinued at any time. The service is provided "as is" and "as available", and to the fullest extent permitted by law we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

BackToYou provides a tool to help connect a finder to a parent. We are not an emergency service and cannot guarantee outcomes. We are not responsible for:

• the actions or inactions of any third party who scans a tag, or who fails to scan a tag;
• failure of NFC or QR technology on any device, or a device that has NFC disabled or unsupported;
• interruption, delay, or unavailability of the service or of any network or internet connection;
• failure or delay of SMS or email delivery due to carrier, spam filtering, or provider issues;
• inaccurate or out-of-date information that you entered or failed to update;
• any damages resulting from use of, or inability to use, the service.

BackToYou is not a substitute for calling 911 or other emergency services, and does not guarantee that a lost child will be found or reunited.

To the fullest extent permitted by law, BackToYou's total aggregate liability arising out of or relating to the service shall not exceed the amount you paid for the product. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, loss of data, or emotional distress, even if we were advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

By using BackToYou, you acknowledge and accept that: (1) NFC technology may fail on certain devices or in certain conditions; (2) SMS and email delivery depends on third party carriers and is not guaranteed; (3) BackToYou is a communication tool only and does not guarantee the safety or recovery of any child; (4) you assume full responsibility for having appropriate backup safety plans including knowing when to contact emergency services.

Any medical notes or health information you add to a tag are provided voluntarily for informational purposes only. This information is not a medical record, is not reviewed by medical professionals, and should never be relied upon for medical treatment decisions. BackToYou is not a medical service.

Any dispute arising from or relating to these Terms or the BackToYou service shall be resolved through binding individual arbitration in Albany County, New York, under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration against BackToYou.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

BackToYou is not liable for any failure or delay in service caused by circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, internet disruptions, carrier outages, or government actions.

You agree to indemnify and hold harmless Tian Chen, sole proprietor and its representatives from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the service, your content, your breach of these terms, or your registering a tag for a child you are not the legal parent or guardian of.

If you are not satisfied with your BackToYou keychain, contact us within 30 days of purchase at support@backtoyoubty.com for a full refund. Digital services (account access, tag activation) are non-refundable once the tag has been activated.

We reserve the right to suspend or terminate accounts that violate these terms, that are used unlawfully, or that put the safety of a child or another user at risk. You may close your account at any time by contacting support@backtoyoubty.com. Sections covering limitation of liability, indemnification, and governing law survive termination.

We may update these terms from time to time. We will notify registered users by email of significant changes, and the "last updated" date will reflect the current version. Continued use of the service after a change takes effect means you accept the updated terms.

These terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. You and BackToYou agree that any dispute will be brought exclusively in the state or federal courts located in New York, and you consent to their jurisdiction.
